Terms of use

These terms of use (the “Terms”) govern the use of the Kipetchi mobile app and this website, published by 2 FRESH STUDIO, a SASU with a share capital of €5,000, SIREN 833 484 520, 20 rue Paul Valéry, 93420 Villepinte, France (“we”). By using Kipetchi, you accept these Terms.

1. The service

Kipetchi is a virtual companion game that encourages simple everyday wellbeing gestures (breathing, hydration, calm, gentle stretching, screen breaks). Your Kipetchi earns Chi when you do these activities, goes on trips and brings back discoveries. You can also add friends, send them gifts and messages, and visit them.

2. Not a medical service

Kipetchi is not a medical device and provides no diagnosis, treatment or medical advice. The suggested activities are general suggestions. Listen to your body and stop if you feel discomfort, dizziness or pain. If you have a health problem, see a professional. In an emergency, call your local emergency number (112 in the EU); if you are going through a hard time, please contact a local helpline.

3. Account

An anonymous account is created automatically on first launch. You can link it to Apple, Google or an email address to keep your progress. Without a linked account, uninstalling the app may result in the loss of your progress. You are responsible for the use of your account.

4. Chi, Diamonds and virtual items

Chi, Diamonds and virtual items have no monetary value and are neither refundable, exchangeable for money nor transferable. Daily caps apply to keep the experience balanced. We may adjust the game economy to improve it. Any attempt to cheat or manipulate the game may result in the related earnings being reset.

Diamond packs can optionally be purchased in the app. They are purchases of consumable digital content: the Diamonds are credited to your account upon purchase and remain subject to the rules above.

5. Kipetchi+

• Kipetchi is free. Kipetchi+ is an optional offer that gives access to additional content (programs and soundscapes, exclusive outfits and decor, destinations, free diamonds every month). It is available as a monthly subscription, a yearly subscription or a one-time “lifetime” purchase.
• Monthly and yearly subscriptions: payment is charged to your App Store or Google Play account. The subscriptionrenews automatically for the same period at the current price unless cancelled at least 24 hours before the end of the current period. You can cancel at any time in your store’s subscription settings (iPhone: Settings → your name → Subscriptions; Android: Google Play → Payments & subscriptions); access remains active until the end of the period already paid.
• Free trial: the yearly subscription may include a 7-day free trial, subject to the store’s eligibility rules (usually once per account). If you do not cancel at least 24 hours before the trial ends, the yearly subscription starts and its price is charged when the trial ends.
• Kipetchi+ lifetime: a one-time payment, with no renewal, giving access to Kipetchi+ for as long as the app is offered. If you had an active subscription, it is not cancelled automatically: remember to cancel it in your store.
• Prices, in your currency, are shown in the app before any purchase. Refund requests follow the rules of the relevant store. You can restore your purchases in the app with the same store account.
• By confirming the purchase of digital content supplied immediately, you request immediate performance and acknowledge that you waive your right of withdrawal, in accordance with Article L221-28 of the French Consumer Code.

6. Acceptable use

You agree not to circumvent technical measures, decompile the app for unlawful purposes, disrupt the service or use automated means to generate earnings.

7. Friends, messages and good conduct

Kipetchi is intended for people aged 16 and over. You can only write to friends you have accepted. The names you choose (your first name, your Kipetchi’s name, your goals), your profile photo and your messages must not be abusive, threatening, harassing, discriminatory, sexual or violent, impersonate anyone or infringe the rights of others. You remain responsible for what you post.

You can report a message (long-press it) and block someone from their profile. We review reports and may remove content, remove a photo, change a name or suspend an account in case of abuse. Virtual items exchanged between friends have no real value.

8. Intellectual property

Kipetchi, its universe, characters, illustrations, texts and software are protected. You are granted a personal, non-exclusive and non-transferable licence to use the app for private purposes.

9. Availability and liability

We do our best to keep Kipetchi running at all times, without being able to guarantee it. The app also works offline and syncs later. We cannot be held liable for use of the activities contrary to the precautions stated above, within the limits provided by law.

10. Deletion and termination

You can delete your account at any time (see how). Deleting your account does not automatically cancel an active subscription: remember to cancel it in your store. We may suspend an account in the event of a serious breach of these Terms.

11. Personal data

How your data is processed is described in our privacy policy.

12. Changes and governing law

We may change these Terms; you will be informed of significant changes in the app. These Terms are governed by French law. In the event of a dispute, you may use a consumer mediator free of charge. Failing an amicable agreement, the competent courts are those provided for by law.
